Canadian Tire Company sues Walmart for copying its Christmas lights

Recently, two large supermarkets, Canadian Tire Corporation, Ltd. and WalMart Canada Corp., went to court for a Christmas light string that can be hung on a Christmas tree. The Canadian Tire Company filed a lawsuit in the court on November 13, claiming that a Christmas lighting sold by Wal-Mart in the fall of this year was suspected of copying the design and packaging of the “Quick-Clip” outdoor Christmas lights of Noma, a lighting brand under Canadian Tire, and violated "Industrial Design Act". Asked Canadian Wal-Mart to stop selling this product and demanded compensation for the tire company’s 500,000 yuan of losses.

According to the product description of the Canadian Tire Company, this Christmas lantern uses a unique socket and elastic clip design, which can safely hang a long string of Christmas lanterns on eaves, roofs, Christmas trees, shrubs and railings. This installation structure allows the light string to be adjusted after it is installed. The Canadian Tire Company said that the design and promotion of the product cost millions of dollars. It will be sold in the fall of 2013, and the sales volume will be good during the Christmas period of the next two years. The Canadian Tire Company also stated that the product design and the "Quick-Clip" name have been applied for registration to prevent the design elements of the product from being plagiarized within 10 years, but the registration application for the relevant trademark is still pending.

In the indictment, the Canadian Tire Company stated that its lantern brand has established a strong position in the market and has been recognized by the Canadian Standards Association. Wal-Mart uses Canadian tire-related product pictures on product packaging, and also named it "Quick-Clip". This is an attempt to misappropriate other people’s mature product design and advertising, in order to evade its own product design and promotion. Fees paid.

In response, Canadian Wal-Mart Company responded that since the case has been handed over to the court, it does not make any comment at this time.
